Superior Court decision kills off Les Marines plan

An attempt to gain official approval for an 18,000 home development in the Les Marines zone of Dénia has finally been killed off by the Superior Court of Justice in Valencia.

In 2003 the Asociación de Promotores Turísticos de Dénia, with the backing of former regional territories councillor Rafael Blasco, submitted the development plan but the recently elected council rejected it.

The matter was taken to court with the plan’s backers claiming that it had been approved at both local and regional level but the decisions had not been published in the relevant bulletins.

After reviewing all of the evidence the court backed Dénia council’s claim that the plan was illegal because it was based on the town’s year 2000 PGOU town plan which was declared illegal by the same court in July 2003.

Official approval of the project, which was based on the old LRAU land law, was given by the provincial government in Alicante subject to the correction of a number of errors and in 2004 the promoters association wrote to Valencia claiming that the errors had been corrected and asking for regional approval.

The Superior Court ruled that because the 2000 PGOU town plan had been annulled it could find no reason why the project should be approved and that the promoters association’s claims had no foundation.

New Bus Station Plans

Dénia council has opened negotiations with the regional infrastructure council over the viability of building a new bus station.
Mayoress Paqui Viciano said that the current site of the bus terminus on Plaza Arxiduc Carles is totally unsuitable and presents a bad image of the town.

She is proposing that the council gives up a site measuring between 10,000 and 12,000 square metres for the construction of the new station in return for a one million euro finance package from regional government.

If the project gets the thumbs up from Valencia, the council intends to build an underground car park in Plaza Arxiduc Carles before turning the surface area into a garden.

Dénia council is preparing a detailed plan of the project which it will submit to Valencia in June. If it is given approval Sra Viciano expects the project to be included in the 2009 regional budget.
